Newbould Inquiry Concludes in light of Judge’s Retirement

Ottawa, 5 June 2017 – The Canadian Judicial Council announced today that the Inquiry Committee constituted in the conduct of the Honourable F. Newbould has stayed its proceedings permanently given the judge’s retirement effective 1 June 2017.

The Committee’s Report provides reasons why it believes that the Council has no jurisdiction to review the conduct of a judge who has retired. Thus, whether the issue is framed as one of jurisdiction or mootness, the Inquiry Committee finds that it is not in the public interest to proceed.

Inquiries concerning judges are mandated to inquire as to whether a judge of a superior court should be removed from office for reasons of misconduct pursuant to the Judges Act. The Council wishes to thank the members of the Inquiry Committee for their work.
