20020005 - The complainant had entered into an agreement with her former husband to have his rights to a judgment assigned to her. A writ of execution had been registered against the judgment debtor. She complained that the judge had refused to have her added as a judgment creditor when the assignment of judgment came up for renewal. She alleged the judge made his decision because her husband was a lawyer and was known to the judge; because he did not recognize child support payments as the obligation of the father; or because her lawyer was a “very young Aboriginal lawyer.”

The complainant was advised that a judicial decision is not reviewable by the Council to determine whether or not it is correct. An error on the part of the judge would not amount to judicial misconduct. She was advised that she had provided no evidence to support her allegations.
