20170021 - The complainant alleges partiality, collusion and incompetence on the part of the judge. He alleges the Court of Appeal repeatedly blocked his efforts to seek justice. He alleges the courts rendered an unfair decision in contempt of Allah’s Sovereignty and the Constitution Act; has failed its mandate and has breached the public trust and duty of care.

A review of the decision rendered by the Court of Appeal does not reveal any indication of hostility, subjectivity, prejudice, Islamophobia or xenophobia. Bold assertions without evidence do not constitute as reliable or credible information to establish discrimination. Furthermore, it is not for the Council to review the judicial decision-making process or manner in which a judge exercises his judicial discretion in the conduct of a case. These matters are appropriately handled in court.

The matter does not warrant further consideration by the Council.
